Kenyans president and his deputy are on trial at the Hague based court, is it fair or not?

The International Criminal Court

The International Criminal Court is a permanent tribunal to prosecute individuals for genocide, crimes against humanity, war crimes. The ICC was created by the Rome Statute which came into force on 1 July 2002.The Court has established itself in The Hague, Netherlands, but its proceedings may take place anywhere. It is intended to complement existing national judicial systems, and may only exercise its jurisdiction when national courts are unwilling or unable to investigate or prosecute such crimes.
Currently, 122 states are states parties to the Statute of the Court, The ICC has been accused by many, including the African Union, for primarily targeting people from Africa

Kenyan cases

Currently there are two cases in the Hague that are targeted to Kenyan leadership. The president HE Uhuru Kenyatta and his deputy William Ruto are on trials. they are joined by a former radio presenter Joshua Sang. President Kenyatta was elected as President of Kenya in the March 2013 presidential election, defeating Raila Odinga with a narrow majority in a single round of voting. The cases at the court cycle around the 2007 post election violence that left over 1133 persons dead and thousand others displaced.

Is it fair for the sitting head of state to be on trials???? this is the case which the African states are asking each time now and then. Yes there was violence during the election but should he be given away to the ICC.

Africa Union

Africa Union is gearing itself to protect their own against the pressure from international court. The union has sent great delegation to major conferences to air their grievances in which they accuse the International criminal court of targeting Africans. They want the court to postpone the cases against Mr. Uhuru Kenyatta and William Ruto postponed by an year. This is to give the two a chance to lead the nation which has just suffered one of the worst terrorism attack in the recent times.

Though I agree with them I see that they do not have the interest of Kenyan at heart. They want impunity to reign in the country and in the continent which is prone to dictatorship and other forms of bad governorship

United Nation Security Council

United council voted against the postponement of the two cases and I agree with them, congratulation to them for not allowing for impunity to reign in the continent. A resolution proposed by African states calling for the deferment was the biggest challenge yet to the trials of President Uhuru Kenyatta and Vice President William Ruto who face charges of crimes against humanity at the ICC. But the resolution got only seven votes, two below the number needed to pass in the 15-member body. Eight council nations, all ICC members or supporters including Britain, France and the United States, abstained to ensure the failure of the resolution.

IS it fair to have a sitting president on trial
