NY Prosecutors, Cops Caught Lying, Occupy Protester Acquitted

Defense lawyers turned the table on prosecutors in the first trial of an Occupy Wall Street demonstrator, gaining an acquittal for their client.

Lying cops and prosecutors

The first jury trial resulting from an Occupy Wall Street Protest ended yesterday, February 28, 2013, with defendant Michael Premo being found innocent of all charges, after his lawyers presented video evidence directly contradicting the version of events claimed by New York police and prosecutors.

Premo, who is an activist and community organizer and recently active in the efforts of Occupy Sandy, which seeks to aid and support victims of last year's hurricane, was one of several hundred people who demonstrated in Lower Manhattan on December 17, 2011.

The demonstration

Demonstrators had occupied Duarte Square, and the cops were bent on clearing the entire area, so they 'kettled' the crowd by surrounding it and using bright orange plastic netting to hem them in. Premo, in the melee, fell to the ground and attempted to crawl out and free himself.

The police version of events, presented at trial, and reported in commondreams.org, was that "Premo charged the police like a linebacker, taking out a lieutenant and resisting arrest so forcefully that he fractured an officer's bone." That is the story prosecutors insisted was the truth of the incident, and it is the same story the arresting officer testified to under oath.

The video shows otherwise

Premo's lawyers, Meghan Maurus and Rebecca Heinegg, set out to find video evidence to support their claim that Premo was being set up for a frame. Although the NYPD constantly filmed all of the Occupy demonstrations, prosecutors and police told the lawyers that no video of the event had been taken. However, Maurus got word that the public television news program Democracy Now had footage of the demonstration, and when she tracked the cameraman down and saw the film, tears came to her eyes.

The video evidence, in a kind of Perry Mason moment, stunned the courtroom. It flipped the evidence on its head, as it showed exactly the opposite of what police and prosecutors were claiming. Whenever Premo tried to get back on his feet, cops repeatedly tackled him and sent him sprawling again to the ground.

After deliberating for a short time, the jury found Premo innocent of all charges. Of course, no charges will be filed against the prosecutors who lied and the cops who committed perjury.

Justice finally served is a breath of fresh air for justice usually falls flat upon its face.

Good for the brave young man Michael Premo and his lawyers who stood on the right side of justice and won.

Steve, our dear friend, I have noticed that upon this page and others (not my own) that advertisements drop down one tier and block the words no matter how many times one refreshes the page.

One wonders what can be done?

Good report Steve . ....

Uthrania..this is something I had not too long ago . It was a nasty bug or virus , and I had to have a friend come and clean it off my page . It won't go on its own . I hope that helps you get it sorted.
